RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, MEDICAL AUTHORIZATION, MEDIA RELEASE, AND ELECTRONIC CONSENT

PLEASE READ CAREFULLY BEFORE SIGNING. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
In consideration for being permitted to participate in, attend, compete in, coach at, volunteer at, officiate at, or otherwise enter areas associated with Who’s Unstoppable Preseason Nationals and any related weigh-in, warm-up, clinic, competition, activity, event, or program organized or promoted by Unstoppable Events, Inc. (“Event”), the participant and, if the participant is under 18 years of age, the participant’s parent or legal guardian, agree as follows:
1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that wrestling is a physical contact sport and that participation involves inherent and other risks that may result in serious bodily injury, permanent disability, paralysis, illness, property damage, or death.
These risks include, but are not limited to:
Falls, throws, takedowns, collisions, and physical contact with other participants;
Sprains, strains, fractures, dislocations, cuts, bruises, and joint injuries;
Head, neck, back, and spinal injuries;
Concussions and other traumatic brain injuries;
Skin infections, communicable illnesses, and exposure to bodily fluids;
Equipment failure or unsafe conditions;
Injuries resulting from the actions or inactions of other participants, coaches, officials, spectators, volunteers, employees, medical personnel, or other persons;
Risks associated with entry into and use of the Event facility; and
Other risks that may not presently be known or reasonably foreseeable.
I knowingly and voluntarily accept and assume all such risks, whether known or unknown, arising from participation in or attendance at the Event.
2. PARTICIPANT RESPONSIBILITY AND SAFETY
I agree that the participant will comply with all Event rules, facility rules, and instructions from officials, referees, coaches, medical personnel, staff, and authorized Event representatives.
The participant shall not participate if injured, ill, medically restricted, or otherwise unable to safely compete.
If the participant or parent/legal guardian believes any condition is unsafe, the participant will immediately stop participating and notify an Event official or representative.
3. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by law, I, on behalf of myself, the participant, and our respective heirs, representatives, executors, administrators, assigns, and next of kin, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE:
Unstoppable Events, Inc.; Who’s Unstoppable Preseason Nationals; the Event facility and its owners/operators; sponsors; affiliates; directors; officers; employees; volunteers; coaches; officials; referees; medical personnel; contractors; vendors; photographers; production personnel; agents; representatives; and any other persons or entities involved in organizing, operating, hosting, promoting, or supporting the Event (collectively, the “Releasees”).
This release applies to any and all claims arising from or relating to participation in, attendance at, or involvement with the Event, including claims involving bodily injury, illness, disability, property damage, or death, including claims arising from the ordinary negligence of any Releasee, to the fullest extent permitted by applicable law.
4. INDEMNIFICATION AND HOLD HARMLESS
I agree, to the fullest extent permitted by law, to indemnify and hold harmless the Releasees from claims, demands, actions, damages, expenses, costs, or liabilities arising from or relating to the participant’s involvement in the Event.
If a claim is brought despite this agreement, I understand that this Release and Waiver may be asserted as a complete or partial defense to that claim.
5. MEDICAL CONDITION AND FITNESS TO PARTICIPATE
I represent that the participant is physically and medically able to participate in wrestling activities.
I understand that it is the responsibility of the participant and/or parent or legal guardian to disclose any condition that may affect the participant’s ability to safely participate.
I understand that Event personnel may remove a participant from competition if they reasonably believe continued participation presents a health or safety risk.
6. EMERGENCY MEDICAL AUTHORIZATION
If the participant becomes injured or ill during the Event and medical care is reasonably believed to be necessary, I authorize Event personnel, athletic trainers, medical professionals, emergency responders, and facility personnel to obtain or provide appropriate medical evaluation and treatment.
If a parent or legal guardian cannot immediately be reached, I authorize medical professionals to provide emergency care they consider reasonably necessary.
I understand that Unstoppable Events, Inc. does not assume financial responsibility for ambulance services, hospital care, physician services, medication, medical treatment, or other healthcare expenses incurred by the participant.
7. COMMUNICABLE DISEASE AND SKIN CONDITION ACKNOWLEDGMENT
I understand that wrestling involves close physical contact and may result in exposure to communicable illnesses, skin infections, viruses, bacteria, bodily fluids, or other infectious conditions.
I agree that the participant will not knowingly compete with a contagious or otherwise disqualifying medical condition and will comply with applicable Event rules and medical clearance requirements.
8. PHOTO, VIDEO, STREAMING, AND MEDIA RELEASE
I understand that the Event may be photographed, videotaped, recorded, livestreamed, broadcast, or otherwise documented.
I grant Unstoppable Events, Inc. and Who’s Unstoppable Preseason Nationals permission to photograph, record, livestream, reproduce, display, publish, and use the participant’s name, image, likeness, voice, competition footage, and Event-related photographs or recordings for Event coverage, promotion, advertising, websites, social media, livestreaming, news coverage, historical archives, and other lawful promotional purposes without additional compensation.
This authorization does not transfer ownership of photographs or recordings independently created and owned by third-party photographers or media companies.
9. PERSONAL PROPERTY
I understand that the participant is responsible for personal property brought to the Event.
Unstoppable Events, Inc. and the Releasees are not responsible for lost, stolen, misplaced, or damaged personal property except as otherwise required by law.
10. MINOR PARTICIPANTS
If the participant is under 18 years of age, the person signing this agreement certifies that he or she is the participant’s parent or legal guardian and has the legal authority to enter into this agreement on the minor participant’s behalf.
The parent or legal guardian acknowledges the risks associated with participation in wrestling and voluntarily gives permission for the minor participant to participate in the Event.
11. PARTICIPANT INFORMATION
I certify that all participant information provided during registration, including the participant’s name, date of birth, age, grade, school or club affiliation, weight, weight class, contact information, and other registration information, is true and accurate to the best of my knowledge.
I understand that providing inaccurate information may affect eligibility, placement, brackets, or participation in the Event.
12. EVENT COMMUNICATIONS
By providing a mobile telephone number and/or email address as part of registration, I consent to receive communications reasonably related to registration and participation in the Event, including information concerning scheduling, weigh-ins, brackets, venue information, registration updates, safety notices, Event changes, and other important Event-related information.
Message and data rates may apply. Where applicable, I may reply “STOP” to discontinue SMS communications.
13. ELECTRONIC SIGNATURE AND CONSENT
By electronically signing the registration form below, I certify that I am either:
(a) the participant and am 18 years of age or older; or
(b) the parent or legal guardian of the participant if the participant is under 18 years of age.
If signing for a minor participant, I certify that I have the legal authority to enter into this agreement on the participant’s behalf.
By signing, I acknowledge that I have read, understand, and voluntarily agree to ALL provisions contained in this agreement, including:
The Release and Waiver of Liability;
Assumption of Risk;
Indemnification and Hold Harmless provisions;
Medical authorization;
Communicable disease acknowledgment;
Photo, video, livestreaming, and media authorization;
Participant information certification; and
Event communications consent.
I understand and agree that my electronic signature has the same force and effect as a handwritten signature.
If I register more than one participant through the same registration transaction, I certify that I am authorized to register each participant and understand that my acknowledgments, authorizations, releases, and consents apply to each participant included in the registration to the extent applicable.
14. SEVERABILITY
This agreement is intended to be as broad and inclusive as permitted by applicable law.
If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. FINAL ACKNOWLEDGMENT
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, MEDICAL AUTHORIZATION, MEDIA RELEASE, PARTICIPANT INFORMATION CERTIFICATION, EVENT COMMUNICATIONS CONSENT, AND ELECTRONIC SIGNATURE AGREEMENT.
I UNDERSTAND ITS TERMS AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT.
I HAVE SIGNED THIS AGREEMENT FREELY AND VOLUNTARILY AND INTEND MY ELECTRONIC SIGNATURE BELOW TO CONSTITUTE MY COMPLETE ACCEPTANCE OF ALL TERMS ABOVE TO THE FULLEST EXTENT PERMITTED BY LAW.
